These Terms and Conditions (“Terms”, “Agreement”) constitute a legally binding contract between you (“you”, “user”) and Martin Grey LLP, operating under the brand name EngineerNow (“EngineerNow”, “we”, “us”, “our”).

These Terms govern your access to and use of:

• The EngineerNow website: https://www.engineernow.org/
• The EngineerNow platform and tools, including InterviewNow, Resume Builder, Resume Scanner, Cover Letter Builder, and any other services, mobile experiences, or interfaces we operate (collectively, the “Platform”).

BY ACCESSING OR USING THE PLATFORM, YOU AGREE TO BE BOUND BY THESE TERMS.

IF YOU DO NOT AGREE, YOU MUST STOP USING THE PLATFORM IMMEDIATELY.

The Platform is intended for users 18 years of age or older.

1. GENERAL NOTICE ABOUT APPLICABLE LAW

EngineerNow operates globally.

We provide a single unified set of Terms intended to apply to all users.

• If you are an EU/UK resident, additional protections under EU/UK consumer law may apply.
• If you are a U.S. resident, arbitration & class action waiver provisions apply.
• If any part of these Terms conflicts with mandatory local law applicable to you, the local law prevails.

2. LICENSE & INTELLECTUAL PROPERTY RIGHTS

Unless otherwise noted, all code, software, databases, functionality, content, design, text, images, graphics, videos, and trademarks (“Content”) are owned by or licensed to EngineerNow and protected under copyright, trademark, and intellectual property laws worldwide.

We grant you a restricted, revocable, non-transferable, non-sublicensable license to access and use the Platform for personal, non-commercial use only.

You may NOT:

• Copy, modify, translate, or create derivative works
• Reverse-engineer or decompile the software
• Use scraper tools, bots, mining scripts, or automated data extraction
• Resell, sublicense, or commercialize any part of the Platform
• Remove copyright notices
• Frame or mirror the Platform
• Use the Platform for competing products or services

All rights not expressly granted are reserved by EngineerNow.

3. USER REPRESENTATIONS

By using the Platform, you represent and warrant that:

1. All information you provide is accurate, current, and complete
2. You will maintain accurate information
3. You have the legal capacity to accept these Terms
4. You are at least 18 years old
5. You will not access the Platform through automated or non-human means
6. You will not use the Platform for illegal purposes
7. You will comply with all applicable laws

We may disable or terminate accounts that violate these representations.

4. USER ACCOUNT

You may need to register to access certain features.

You agree to:

• Keep your password confidential
• Not share your account with others
• Be responsible for all activities under your account

We may refuse, change, or remove any username we consider inappropriate.

5. PAYMENTS, SUBSCRIPTIONS & BILLING

Paid services are processed exclusively via:

• Stripe
• Prodamus

You agree to:

• Provide accurate billing information
• Authorize recurring charges (if applicable)
• Pay all applicable fees and taxes

Refund Policy

Consumers in jurisdictions with statutory withdrawal rights (e.g., EU/UK) may request a refund within 14 days, unless they have expressly chosen to receive immediate access to digital content and waived the right to withdraw.

For all other regions, refunds are handled individually at our discretion.

6. PROHIBITED ACTIVITIES

You agree NOT to:

• Sell, share, or transfer your account
• Use the Platform for commercial purposes
• Impersonate others
• Post harmful, abusive, defamatory, or unlawful content
• Engage in data scraping, data mining, or automated collection
• Upload malware, viruses, or harmful scripts
• Interfere with security features
• Harass, threaten, or harm other users
• Attempt unauthorized access to servers or systems
• Use the Platform to compete with us

Violation may result in immediate termination.

7. AI TOOLS & INTERVIEWNOW DISCLAIMER

EngineerNow provides AI-powered tools (including InterviewNow) solely for educational, informational, and training purposes.

You understand and agree that:

• AI-generated responses may be incomplete, inaccurate, or misleading
• AI tools are NOT a substitute for professional advice or real interview practice
• AI tools do NOT guarantee any job, interview outcome, or performance improvement
• You are solely responsible for evaluating and verifying AI-generated responses

No Liability for AI Output

EngineerNow is not responsible for:

• Incorrect or unreliable answers generated by AI
• Negative outcomes in real interviews
• Hiring decisions or lost opportunities
• Misinterpretation or misuse of AI-generated content

BY USING THE PLATFORM, YOU AGREE NOT TO HOLD ENGINEERNOW LIABLE FOR ANY CONSEQUENCES RELATED TO AI OUTPUT.

8. USER-GENERATED CONTENT

If the Platform allows you to submit content (reviews, text, resumes, etc.):

• You represent you have rights to that content
• You grant us a worldwide, royalty-free license to host, process, and use it to provide services
• You retain ownership of your content
• We may remove any content violating these Terms

We are not responsible for content posted by users.

9. THIRD-PARTY SERVICES & LINKS

The Platform may link to third-party websites or tools.

EngineerNow is not responsible for:

• Content on third-party sites
• Privacy practices of third parties
• Products or services offered by third parties

You access third-party services at your own risk.

10. DISCLAIMER OF WARRANTIES

THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

We disclaim all warranties, express or implied, including:

• Accuracy
• Reliability
• Availability
• Merchantability
• Fitness for a particular purpose

We do not guarantee:

• Continuous availability
• Error-free operation
• Accuracy of AI tools or data
• Protection from malware or attacks

You use the Platform at your own risk.

11. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

EngineerNow is not liable for any:

• Lost profits
• Lost data
• Business interruption
• Inaccurate AI answers
• Damages caused by reliance on AI or content
• Security breaches
• Indirect, incidental, or consequential damages

OUR TOTAL LIABILITY TO YOU IS LIMITED TO:

THE AMOUNT YOU PAID IN THE 3 MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.

12. INDEMNIFICATION

You agree to indemnify and hold harmless EngineerNow from any claims or damages arising from:

• Your use of the Platform
• Your violation of these Terms
• Your infringement of third-party rights
• Your misuse of AI or content

13. MODIFICATIONS AND SERVICE INTERRUPTIONS

We may update, modify, suspend, or discontinue the Platform at any time.

We are not liable for:

• Downtime
• Data loss
• Interruptions
• Feature changes

14. GOVERNING LAW

Unless overridden by mandatory national law:

• These Terms are governed by UK law
• Jurisdiction: Courts of England and Wales

15. DISPUTE RESOLUTION – ARBITRATION (NON-EU USERS)

If you reside outside the EU/UK:

• You agree to resolve disputes via binding arbitration
• You waive the right to participate in class actions
• Arbitration venue: London, UK (virtual hearings allowed)

16. EU/UK CONSUMER NOTICE

If you reside in the EU/UK:

• You may have additional consumer rights (refunds, withdrawal, dispute procedures)
• Nothing in these Terms overrides mandatory local law

17. TERMINATION

We may suspend or terminate your account if:

• You violate these Terms
• You misuse AI tools
• Your activity poses a security risk
• You provide false information
• You may not create a new account after termination without our consent.

18. Disclaimer for Courses, Books and Consultations

EngineerNow offers educational products and services including, but not limited to, the Engineer-Millionaire online course, the Engineer-Millionaire book, and personal or professional consultations or coaching sessions (“Educational Services”).

18.1 No Guarantees of Results or Income

You acknowledge and agree that:

• Educational Services are informational and educational only.
• EngineerNow does not guarantee that you will achieve any specific financial results, income level, salary increase, job offer, interview outcome, career progression, investment performance, business opportunity, or personal transformation.
• Any examples of earnings, success stories, testimonials, case studies, or results mentioned on our website, courses, book, videos, or marketing materials are illustrative only and should not be interpreted as typical, guaranteed, or expected results.

Your results depend on your own effort, background, market conditions, economic factors, skills, experience, and personal circumstances, all of which are outside our control.

18.2 No Professional Advice

Educational Services are not:

• financial advice
• investment advice
• legal advice
• tax advice
• psychological or medical advice
• professional engineering advice
• employment or recruitment services

We provide general educational information only.

You must consult qualified licensed professionals before making any decisions that could affect your finances, taxes, career, business, or well-being.

18.3 Personal Responsibility

By using Educational Services, you agree that you:

• take full responsibility for your actions and decisions
• will not hold EngineerNow responsible for your financial losses, missed opportunities, job rejections, business failures, or negative outcomes
• understand that all actions you take based on course/book/consultation content are done voluntarily and at your own risk

18.4 Consultations and Coaching Sessions

During coaching or consultation sessions:

• we may offer opinions, strategies, or suggestions
• these are not guaranteed to be accurate, effective, or suitable for your situation
• we do not guarantee that following them will produce any results

You agree not to make any legal claims, demands, or complaints against EngineerNow regarding the outcomes of advice provided during consultations.

18.5 No Employment or Income Promises

EngineerNow does not guarantee:

• employment
• job placement
• salary increase
• visa approval
• acceptance into professional programs
• business revenue
• investment returns
• passive income
• career promotions
• improved interview performance
• improved employer interest in your resume

All decisions regarding hiring, promotions, visas, or contracts are made by third parties completely outside our control.
